Progress Report, LLC PRIVACY POLICY

Use by Persons Under 18 Years of Age Prohibited

The Websites and the Services are not directed to children and are intended solely for use by persons 18 years of age or older. All persons under 18 years of age are prohibited from registering on the Websites and prohibited from providing any information to Progress Report, LLC (“Progress Report”) on the Websites. We do not knowingly collect any personal information from individuals under 18 years of age by and through the Websites or the Services. If you believe that a child in your care has registered on the Websites, or has otherwise provided us with personal information, please contact us. We may ask you to provide additional information to verify your identity and your authority to act on the child's behalf before taking appropriate action, if any, to remove or disable any personal information in our control.

General

Progress Report values your privacy. The Websites allow internet users to opt-in to advertising offers by submitting email addresses and other personal information to Progress Report and its Marketing Partners, who collectively constitute the Progress Report advertising network (“Progress Report Advertising Network”). Like any website for which you register and provide information about yourself, it is advisable to pay attention to what personal information you disclose and to which parties. At Progress Report, we understand this and have established this Progress Report, LLC Privacy Policy (“Privacy Policy”) to explain how information is collected on the Websites and how this information is used and disclosed. By using the Websites or by submitting any information through the Websites that provide promotional offer services made available to you on the Websites (the "Services"), you consent to the terms of this Privacy Policy.

User Information Collected on the Websites

Information Users Voluntarily Provide to Us

When users access the Websites, personal information may be provided to us in the form of data passed by the website referring them to us (where the users gave permission to pass such information), or in the form of information that we request in one or more registration forms ("Registration Information"). Any term of this Privacy Policy applicable to or referencing personal information shall also be applicable to Registration Information; any term of this Privacy Policy applicable to or referencing Registration Information shall also be applicable to personal information. Registration Information requested may include, without limitation, the user's first and last name, email address, mailing address, telephone number, gender, date of birth and other personal information. We encourage you to submit this Registration Information so that we can provide you with a more personalized experience on the Websites and in promotional communications. At times, Progress Report may combine your Registration Information with information we obtain from other companies or sources. If so, this Privacy Policy governs the information provided by those third party sources, and any terms of this Privacy Policy which are applicable to your Registration Information are also applicable to information we obtain from other companies or sources.

If your personally identifiable information changes, or if you no longer desire to use the Services, please contact Progress Report to update or delete your information pursuant to the Privacy Policy.

If you opt-in to advertising offers on the Websites, Progress Report will send your Registration Information to the applicable Marketing Partner. The Marketing Partner, or Progress Report on behalf of the Marketing Partner, may contact you with email messages to the email address you provided during registration, with telephone calls, faxes or postal mail directed to the postal mailing address that you supplied. After you opt-in to an advertising offer on the Websites, your Registration Information is also subject to the applicable Marketing Partner’s policies governing use and disclosure of such Registration Information. Progress Report may also contact you with promotions, offers, or advertisement communications relating to the products or services of any of the members of the Progress Report Advertising Network with email messages to the email address you provided during registration, with telephone calls, faxes or postal mail directed to the postal mailing address that you supplied.

Cookies and Passive Data Collection

Progress Report automatically, or "passively," may collect certain standard user information and clickstream data (a record of click selections) for all users of the Websites. For example, we may log a user's Internet Protocol ("IP") address, operating system, browser type, time and date of visit and page views. We may collect this information through the use of server logs, "cookies" and "pixel tags." Any terms of this Privacy Policy which are applicable to your Registration Information are also applicable to information collected passively.

Cookies are small data files sent by a website to a user's browser and hard drive that identify the user's computer to the website. We may use cookies on the Websites to validate users' sessions on the Websites, to administer the Websites, to provide the Services, and to allow enhanced features, such as recognizing users. We may also use cookies to enable customizable content and other new features for users as such content and features become available. Where a user rejects a cookie, he or she may not be able to access and/or use all features on the Websites including, without limitation, certain features of the Services.

Pixel tags are tiny graphic files that are included in web pages, HTML-encoded email messages and certain other types of content, which may read cookies.

Pages on the Websites may also contain similar pixel tags that allow us to count users who have visited those pages, to compile aggregated statistics about the Websites usage and to deliver co-branded and other new features and services as they become available. Pixel tags on the Websites may collect information such as a cookie number, time and date of a page view and a description of the page on which the pixel tag resides. We may use information gathered from pixel tags to improve the content of the Websites and email messages, to help us diagnose problems with our servers and other equipment, to administer the Websites, to provide the Services and to provide new or enhanced features or tailored products or services to our users as they become available.

Advertisers and other third parties may place third-party elements, including pixel tags, JavaScript code or similar code on the Websites, and may use other tools and techniques, to gather information about users of the Websites. These third party elements may be used on the Websites to monitor the effectiveness of advertising or to collect anonymous tracking information. These third parties may also place cookies on the Websites, which may be used to gather anonymous tracking information and the same types of information as we collect by using cookies. These cookies may be placed on the Websites in conjunction with pixel tags and pieces of code placed on the Websites by that third party. Information collected by these third parties in these ways is subject to those third parties' policies governing use and disclosure of personal information.

We may link information gathered by passive information collection methods to your Registration Information and other personal information we obtain about you from other sources. If we cross-match information in this manner, we will treat such cross-matched information as personal information under this Privacy Policy. Additionally, user IP address, web browser, operating system, screen resolution, language, country and visit date are gathered by passive collection methods for the purpose of ensuring that advertising offers are targeted to user demographics. This information may be disclosed to third parties under the same circumstances as personal information under this Privacy Policy.

When users visit particular pages within the Websites, personal information may be placed in the URL or in an HTML form POST. This allows customized features for the user. Users should be aware that other websites visited before entering the Websites might place personally identifiable information within a user's URL during visits to those websites, and Progress Report has no control over the practices of such websites. Accordingly, some of this information may be logged by a website that collects URL information that the user visits.

How Progress Report Uses the User Information

Personal Information

Progress Report generally uses personal information for the purposes of operating the Websites and Services, in the course of sending you promotional and informational communications on behalf of Progress Report and Marketing Partners, and in the course of providing information to various third party advertisers and marketers. For example, where a user has submitted Registration Information on the Websites, the Progress Report Advertising Network (including Progress Report, acting on behalf of Marketing Partners) may send, and the users may receive, correspondence, including postal mail, email, telephone calls and faxes regarding products or services offered by members of the Progress Report Advertising Network. We may also use Registration Information to send sales lead information to our third party advertising partners or advertising brokers who may use the sales lead information to contact users regarding products or services. Users who submit Registration Information on the Websites consent to be contacted by advertisers regarding products or services, and such advertisers may send, and the users may receive, correspondence, including postal mail, email, telephone calls and faxes regarding other third party advertisers’ products or services.

We also may use personal information of users to process transactions on the Websites, to provide support for the Services, to otherwise respond to users’ requests and inquiries, to maintain a record of dealings with our users, to develop new products and services and to send information regarding products and services that we or our advertisers think our users might find of interest or useful. When we use your personal information in our marketing efforts, we provide you with choices (see "Opt-Out," below).

Information Sharing and Disclosure

We may share, license or sell your information to third parties for various marketing purposes, including their online (e.g., email marketing) and offline (e.g., telemarketing, text messaging (where and to the extent permitted by law), skip tracing and direct mail) marketing programs.

Without limiting the foregoing, by providing Registration Information on the Websites, you agree that such act constitutes an inquiry and/or application for purposes of the Amended Telemarketing Sales Rule (16 CFR §310 et seq.), as amended from time to time (the “Rule”) and applicable state do-not-call regulations. As such, notwithstanding that your telephone number may be listed on the Federal Trade Commission’s Do-Not-Call List, and/or on applicable state do-not-call lists, we retain the right to contact you via telemarketing in accordance with the Rule and the applicable state do-not-call regulations.

In addition, by submitting your Registration Information on the Websites, you agree to receive mobile marketing including, but not limited to, text-message based marketing, from the Progress Report Advertising Network, from third party advertising partners, and other third party marketers (where, and to the extent that, such marketing is permitted by applicable law). As such, notwithstanding that your mobile telephone number may be listed on state and/or federal Do-Not-Call registries, we retain the right to contact you via text-message based marketing in accordance with applicable state and federal law. Further, you agree that we reserve the right to share, sell, rent, lease and/or otherwise distribute your mobile telephone and other mobile data with/to any third-party for any and all non-marketing uses permitted by this Privacy Policy and applicable law.

We may also transmit your personal information to advertisers and advertising brokers when you provide information requested on the Websites in response to an offer. By submitting Registration Information on the Websites, you expressly consent to the transmission of Registration Information to Progress Report’ Marketing Partners, third party advertising partners, and other third party marketers. When you consent to transmit your personal information to Progress Report or a third party by providing information requested by the Websites, you also consent to being contacted by postal mail, fax, telephone or email to any of the addresses or numbers that you provide. The personal information transmitted to advertisers may include any of your Registration Information.

Some Marketing Partners using websites do not initially collect all personal information necessary to provide users with targeted advertising offers. In such cases, Progress Report collects the necessary personal information through an additional registration form hosted on the Websites. The personal information collected in this manner may include any of the following: first and last name, email address, mailing address, telephone number, fax number, gender and date of birth. Progress Report may share this additional personal information with any member of the Progress Report Advertising Network, as well as other third party advertising partners and third party marketers. In such cases, the privacy policy of the originating third party website will govern the third party’s use of the additional personal information collected in this manner.

Progress Report may incorporate third party applications, software, or services (collectively, “Third Party Services”) into the Websites, including but not limited to online payment services. All information provided to third-party entities through Third Party Services is subject to those entities' privacy policies and other applicable policies. You understand and agree that Progress Report and other members of the Progress Report Advertising Network do not have any control over the privacy and security practices and policies of Third Party Services, and do not have any control over payment or transaction processes of Third Party Services. We urge you to review each such third parties' privacy policies, and other applicable policies, before consenting to the transfer of your personal information and before agreeing to complete any payment transaction on the Websites using Third Party Services.

We may provide personal information, under confidentiality agreements, to third parties who work on behalf of, or with, Progress Report to assist us in performing non-advertising functions necessary to operate our business, such as validation services.

In order to provide targeted advertising offers to you, we may on occasion supplement the personal information you submit to us with information from third-party sources:

Verification

We may use third-party services to verify your address and telephone number in order to ensure your eligibility to participate in certain advertising offers.

Enhancement of Profile Information

We may purchase marketing data from third parties and add it to our existing user database, to better target our advertising and to provide pertinent offers in which we think you would be interested. To enrich our profiles of individual customers, we may tie this information to the personally identifiable information they have provided to us.

We may pre-populate the forms on the Websites with your personal information, provided, however, that telephone number and email address will not be pre-populated by Progress Report and must be re-entered each time by the user on applicable third party registration/order pages. (Note, however, that your personal information may be pre-populated as a function or feature of your browser, browser plugin, software, or other application that you use in conjunction with your use of the Websites). Progress Report may not show all pre-populated forms to users. This personal information is not submitted to Progress Report, the Progress Report Advertising Network, or any a third party until you submit the personal information by responding in a way that indicates an interest in the applicable offer, such as clicking the applicable submit button.

A user's personal information, usage history and other collected information may result in the presentation of specifically tailored special offers.

Aggregate Non-Identifying Statistical Reports

We may also produce aggregate reports for Marketing Partners and other third parties. For example, we may report to Marketing Partners and other third parties the number of users who clicked on an advertising offer, the average length of time users viewed a particular page on the Websites or the number of users who visited different portions of the Websites. These aggregate reports do not include personal information about users or any specific user's online usage patterns. We may also provide this aggregate information to third parties for performing optimization of the Websites.

Business Transfers

Information about our users including, without limitation, personal information, may be disclosed as part of a merger, acquisition, debt financing or sale of company assets, as well as in the event of an insolvency, bankruptcy or receivership in which personal information could be transferred to third parties as one of Progress Report' business assets (each, a "Business Transfer"). We will make reasonable efforts to notify all users of any Business Transfer, and any users so notified may choose to remove any of their Registration Information at that time.

Promotional Opt-In

During use of the Websites, you may be given the opportunity to sign up for special offers and/or promotional advertisements from the Progress Report Advertising Network. If you are presented with such an optional advertisement, you can provide information or respond by activating a data entry element to indicate your interest in the offer. We may pre-populate the webpage of the offer with your personal data, which may then be supplied to the applicable Marketing Partner, provided, however, that telephone number and email address will not be pre-populated by Progress Report and must be re-entered each time by the user on the Websites. When you submit your Registration Information, Progress Report may share some or all of your Registration Information with the Progress Report Advertising Network and send advertisements to you on behalf of Marketing Partners. Progress Report may share some or all of your Registration Information with third party advertising partners and other third party marketers that may send advertisements to you. Do not indicate interest in an offer by submitting Registration Information if you do not wish to send personal information to and do not want to receive advertisements from the Progress Report Advertising Network, its third party marketing partners, and other third party advertisers.

In addition, you may also be given the opportunity to participate in a special promotion hosted by a third party website. Any personal information that you provide in these circumstances may be transferred by the third party website to the appropriate advertiser(s). Although Progress Report may have independently received similar information from your use of the Websites, Progress Report may not have access to any information that you provide on a website hosted by a third party. In order to enhance the Services we provide, we may pre-populate data fields on a third-party offer form with your Registration Information or other personal information that you have provided to Progress Report, but this pre-populated information is not submitted to any party until you submit the Registration Information by activating an associated web control. Please be advised that your telephone number and email address will not be pre-populated by Progress Report and must be re-entered each time by you on applicable third party registration/order pages. We may also provide your personal information in a URL that refers you to the website of a third party. All information provided to third-party entities is subject to those entities' privacy policies and other applicable policies. We urge you to review each such third party's privacy policy, and other applicable policies, before consenting to the transfer of your personal information in this manner.

Third Party Links

The Websites may also contain links to third party websites. Links from the Websites to other websites or content (whether or not such links are contained in advertisements) do not constitute Progress Report's affiliation with or endorsement of such websites or content. These third-party links are provided for your convenience only, and we do not have control over the content or privacy and security practices and policies of such third parties or other websites. Any personal information that you provide on linked pages is provided directly to that third party and is subject to that third party’s privacy policy. We encourage all users to read the privacy policies of each and every website visited when navigating away from the Websites.

Law Enforcement; Protection of Safety; Enforcement of Terms of Service

Progress Report may disclose users’ personal information where we believe doing so is necessary or appropriate to: (a) comply with applicable law (e.g., to respond to subpoenas, court or administrative orders or legal process); (b) establish or exercise our legal rights or defend against legal claims; or, at our sole discretion (c) investigate, prevent or take action: (i) regarding illegal activities or suspected fraud; (ii) where we deem necessary to protect the safety of any individual or the public; (iii) to prevent the violation of the Progress Report, LLC Privacy Policy (“Privacy Policy”); or (iv) to protect the rights or property of Progress Report or any third party.

Security

We have implemented commercially reasonable security measures in an effort to prevent loss, misuse and alteration of personal information while it is under our control. However, no data transmitted over the Internet or stored electronically can be 100% secure. As a result, while we strive to protect your personal information, we cannot guarantee the security of any information that we collect under this Privacy Policy.

In compliance with applicable federal and state law, we shall notify you and any applicable regulatory agencies in the event that we learn of an information security breach with respect to your personal information. You will be notified via email in the event of such a breach. Please be advised that notice may be delayed in order to address the needs of law enforcement, determine the scope of network damage and to engage in remedial measures.

Progress Report is committed to protecting the privacy of our users, and we will continue to review and implement new technologies as necessary to maintain the security of our networks and servers.

Modifying or Deleting User Information

Users may request to modify or delete the information they have submitted to us. This may be done by the following method:

If you would like to modify or delete your personal information maintained by Progress Report, please contact us and state the information that you would like modified or deleted. We will accommodate your request within fourteen (14) days and may contact you to request additional information in connection with, or prior to, processing your request. Please note that, while your request may result in a modification or deletion of data stored by Progress Report, this action will not be propagated to Marketing Partners nor any other third parties that have received your information. To change or delete the data received by Marketing Partners and other third parties, you will need to contact them directly.

Opt-Out

By submitting your information on the Websites, you are consenting to receive marketing communications from the Progress Report Advertising Network, its third party advertising partners, and other third party advertisers. If, after you have shared your information with Progress Report, you decide that you do not want to receive marketing communications from Progress Report, you can discontinue the communications by emailing copyright@progressreport.com and asking for and following the opt-out instructions. If you have registered or submitted information under more than one email account, you must submit separate unsubscribe requests for each account. Please note that, while your opt-out request will enable you to opt-out from receiving marketing communications directly from Progress Report, including marketing communications from Progress Report on behalf of Marketing Partners, this action will not cause you to opt-out of marketing communications sent directly from Marketing Partners nor any other third parties that have received your information. To opt-out of marketing communications sent directly from Marketing Partners or any other third parties that have received your information, you will need to contact them directly or otherwise use their applicable opt-out procedures.

We may provide information to third parties, and third parties may independently collect information about users as described in this Privacy Policy. Information shared with, or collected by, these third parties is subject to those third parties' policies governing use and disclosure of personal information. Users should contact those third parties directly if they do not wish to receive communications from them, do not want those third parties to collect information about them or wish to take any other actions with regard to such information.

No Spam Policy

Progress Report is opposed to unsolicited commercial email that violates applicable law. Progress Report prohibits all users from engaging in any activity involving unsolicited email. Violations may result in immediate termination of the user's license to access the Websites and the Services and/or legal action against any spammer.

Sending unsolicited email advertisements to or through Progress Report’s computer systems or Progress Report servers located in the States of California and Texas and elsewhere, is strictly prohibited. Any unauthorized use of Progress Report’s computer systems is a violation of this Privacy Policy and may violate certain federal and state laws including, without limitation, the Computer Fraud and Abuse Act (18 U.S.C. Section 1030 et seq.), Section 502 of the California Penal Code and Section 17538.45 of the California Business and Professions Code. Such violations may subject the sender and his or her agents to civil and criminal penalties.

Revisions to this Privacy Policy

If we decide to change this Privacy Policy, we will post those changes within this Privacy Policy, with notice provided on the Websites’s home page and such other locations that we deem appropriate so that you are aware of what information we collect, how we use it and under what circumstances, if any, we disclose it.

We reserve the right to modify this Privacy Policy at any time, so please review it frequently. If we make material changes to this Policy, we will notify you within this Privacy Policy, by email and by a notice posted on the Websites’s home page.
